When the Developer Disappears: How to Resolve a Conflict Without Court?

Legal Way to Resolve a Conflict with the Developer in Bali

We suggested they use an effective tool provided by Indonesian law — an official legal warning.

According to Article 1238 of the Indonesian Civil Procedure Code, before filing a lawsuit in court, the party whose rights were violated is required to send a written notification (Somasi) to the other party demanding they fulfill their obligations or rectify the violation.

Although for most Russian-speaking clients this practice may be new, it acts as a legitimate and important step. In practice, it often helps avoid lengthy proceedings and significantly speeds up the process.

When clients approached us, we prepared an official letter with a legal warning, referencing all contract terms and current Indonesian legislation. This letter became not just a formality but a real lever of pressure on the developer, who did not want to take the matter to court.

The company's management agreed to pay the costs in full, as provided. Construction reports were also provided, which positively affected the relationship between the parties, and clients agreed to adjust the villa's delivery dates.

Above all, it is an opportunity to solve the problem quickly and without unnecessary costs. Going to court in Indonesia is a process that can drag on for months, if not years. However, a legal warning can resolve the issue with just a couple of letters.
