A Tree Fell on a Hotel Guest in Bali: How to Get Compensation Without Going to Court

In late November 2025, a tree came down on a tourist at a hotel in Bali and injured her badly. She had come to the hotel for a single day, on a day pass. Eight months later, the resort paid her compensation of more than USD 13,000, and all of it without a court case.
Let us look at why she was entitled to it, which documents made her position strong, and what to do if you find yourself in a similar situation.
What Happened
The woman was relaxing on the hotel grounds, having paid for day access, when, through no fault of her own, a tree fell on her. The injuries were serious: broken ribs, a concussion, and damage to her head, neck, shoulder, and back, followed by persistent migraines. Treatment took a long time and was largely at her own expense, back home.
Why the Hotel Is Liable Under the Law
Indonesian law recognizes the concept of an "unlawful act": where someone has caused harm to another and is obliged to compensate for it. Three articles of the Civil Code (KUHPerdata) apply in such cases:
Article 1365. Harm caused to another must be compensated.
Article 1366. You are also answerable for what you failed to watch over, that is, for negligence.
Article 1367. Liability arises not only from your own actions but also from things under your supervision.
A tree falling on hotel grounds fits squarely into this logic: whoever controls the premises is answerable for their condition.
Why the Tourist Had a Strong Position
It is worth understanding one simple point here: the fact of an injury at a hotel does not by itself mean the money will be paid automatically. Under the law, the burden of proof is on the injured party. Cases are won with documents, not complaints.
Her documents were close to ideal:
an incident report in which the manager himself acknowledged that everything happened on hotel grounds;
the hotel paid for first aid, which is how parties usually behave when they recognize their fault;
witnesses, including hotel staff;
photos and video from the scene;
medical records and scans linking the injuries specifically to that fall.
Without the incident report and the medical paperwork, the same claim would have been far weaker.
How the Case Was Settled Without Court
It never reached court: the matter was resolved at the pre-trial stage. The instrument was a somasi, a formal letter of demand. Acting for the client, an advocate set out the substance of the claim to the hotel along with the amount to be compensated.
This is not an empty piece of paper. Even if a case later goes to court, a somasi shows that the person wanted to resolve the matter amicably rather than litigate straight away. And in practice, serious companies in Indonesia do respond to a well-prepared demand from an advocate.
After the letters and an in-person meeting between the advocate and the parties, an agreement was reached. The hotel's management did not try to avoid responsibility and moved toward a settlement. The parties then agreed on the amount and signed a settlement agreement.
The Settlement Agreement: The Final Document, Read Closely
A settlement agreement closes the matter for good. A well-drafted one resolves it completely; a weak one leaves gaps that turn into delayed payment, a reduced amount, or fresh disputes. So it is worth signing only after the wording on the amount, the payment deadlines, and the scope of the claims being released has been reviewed.
What to Do If This Happens to You
Keep every medical document and receipt. Diagnoses, scans, reports, expenses. These are what prove the harm and its link to the incident.
Do not sign a waiver of claims in the first days. A hotel may offer money in exchange for giving up any further claims while you still do not know how serious the injuries are.
Work through a licensed advocate. An advocate's PERADI membership can be verified by card number.

The law will not arrange compensation on its own. The same set of circumstances can lead to an actual payout, or to a refusal, or to a signature on an unfavorable document. Preparation makes the difference: someone has to turn a set of facts into evidence, frame the claim correctly, negotiate with the hotel, and review the settlement agreement before it is signed. The injured party's job is simpler: gather every document and receipt you can, and do not sign anything unnecessary.
