Fatal road accident in Bali: how we helped a client avoid a criminal case

In Indonesia, even a single serious traffic accident can quickly escalate into a criminal investigation. Once the police become involved, the consequences for a foreign national may include not only court proceedings but also the risk of imprisonment.
This was exactly the situation one of our clients faced.
What Happened
During heavy rain, the driver lost control of the vehicle and crossed into the opposite lane, causing a traffic accident.
Our client did not leave the scene. He immediately called an ambulance, paid for the injured person’s hospitalization, and acted responsibly after the accident.
Unfortunately, the injured party later died from the injuries.
Following the death, the police opened an official investigation. For a foreign national in Indonesia, incidents like this almost always create a real risk of criminal charges.
What Needed to Be Done Immediately
Our role was not to “bypass the law,” but to build the correct legal strategy and minimize the legal consequences.
In situations like this, communication with the victim’s family plays a critical role. In Indonesian legal practice, mediation and reconciliation between the parties often form an important part of resolving such cases.
The negotiations took place at the police station. It was essential to demonstrate that the client was not trying to avoid responsibility, but rather acknowledging the tragedy and showing a sincere willingness to support the victim’s family.
The Result
Following the negotiations, the parties agreed on the terms of settlement and signed a written agreement confirming that neither side had further claims.
This document played a crucial role. It formally confirmed reconciliation and stated that the victim’s family did not insist on further legal prosecution.
After the agreement was signed, the police officially confirmed that no criminal case would be initiated, and the incident was classified as an accident.
With proper legal guidance, it is often possible to conduct negotiations with the victim’s family, formalize a mutual settlement agreement, and resolve the conflict before it reaches court.
However, it is important to understand that acting independently in such situations can easily make things worse. Incorrect statements or attempts to “resolve the matter privately” may lead to serious legal consequences.
