Case Study: Overstay Due to Visa Agent's Mistake

Situation
The client applied for a visa through a third-party visa agent for processing and support.
Before her departure, she confirmed with the agent whether everything was in order with her status. The agent assured her that there were no issues and that no changes had been made to her permitted stay.
However, during immigration control, it was discovered that the permitted stay had been shortened (D12), and the ITK had not been updated. As a result, a 5-day overstay occurred, which the client had to pay for herself. The fine amounted to approximately IDR 5,000,000.
What Happened Next
After the issue was identified, the agent:
refused to accept responsibility;
stopped responding;
blocked the client;
stated an intention to file for cancellation of the active visa.
The client found herself in a situation of uncertainty: the fine had already been paid, the agent disappeared, and the potential visa cancellation created additional stress.

Contacting Legal Indonesia
The client contacted us due to the risk of visa cancellation.
We checked the status and confirmed that the visa was valid.
We analyzed the situation with the ITK, the grounds for cancellation, and possible pressure from the agent.
We provided a clear plan of action to maintain legal stay.
Why Situations Like This Happen
In Indonesia, responsibility for complying with the permitted stay period formally lies with the foreign national, even if a third party handles the visa process.
If an agent fails to track changes to the stay permit or does not update the required documentation in time, the consequences fall on the client.
Unfortunately, in the market there are cases where agents:
fail to inform clients about important updates (such as shortened stay periods);
do not properly update documents;
refuse to take responsibility;
attempt to terminate communication by blocking the client.
Important to Remember
Before departure or visa extension, it is always advisable to independently verify your current immigration status. If you have doubts, seek an independent review.
We regularly handle similar cases and know how to act within the legal framework.
If you have questions about your visa or concerns about your agent’s actions, contact us. Sometimes a timely check is enough to prevent serious consequences.
